La falta de medios materiales y personales unida al hecho de que la gran mayoría de los conflictos acaba en el ámbito judicial, en lugar de resolverse atreves de otros procedimientos como la mediación, ponen en tela de juicio el funcionamiento de nuestro sistema judicial. Como podría revertirse esta situación? Entramos en la facultad de derecho en la universidad de Málaga para asistir a una experiencia pionera en España. Este grupo de profesores debate cuestiones referentes a un caso de expropiación que le ha llegado desde la sale de lo contencioso administrativo del tribunal superior de justicia de anda lucia. No se trata de dictar sentencia. Eso es una labor intransferible de los jueces. Su objetivo es facilitarles información de forma rápida y ordenada. Desde resúmenes de los autos hasta la búsqueda de jurisprudencia para los casas. Un año después de su puesta en marcha, los resultados de esta iniciativa son sorprendentes. A permitido dictar tres mil sentencias más que el año anterior, incrementando su capacidad resolutiva en más de un ciento veinte por ciento. Este modelo es especialmente efectivo en el estudio de casos que son muy similares entre ellos. Ya que permite aplicar más o menos los mismos criterios. Sin embargo, pese a su novedad en España esta figura del asistente del juez ya está implantada en otros países como Alemania, Francia, Austria, Bélgica o en instituciones como El Tribunal Europeo de Derechos Humanos demostrando su efectividad y su capacidad de proteger legalmente a los ciudadanos.

The lack of material and human resources coupled with the fact that the vast majority of conflicts in the judiciary scope, instead of resolving with different procedures, such as mediation, they call into question the function of our judicial system. How can this situation be reversed? We entered law school at the University of Malaga to attend a pioneering experience in Spain. It has been able to issue three thousand more sentences than the previous year, increasing its response capacity in more than one hundred twenty percent. This model is especially effective in the study of cases that have similarities between them, since it applies more or less the same criteria. However, despite its novelty in Spain this figure of assistant judge, is already being implemented in other countries such as Germany, France, Austria, Belgium or in institutions such as the European Court of Human Rights demonstrating its effectiveness and ability to legally protect citizens.
